1 Who we are and what this covers

These terms are between you and Novato Tech, which is NADAR & CO PTY LTD, trading as Novato Tech (ACN 671116091, ABN 36671116091). In these terms, "we" and "us" mean Novato Tech. We provide the Novato Trade app, which helps an individual trade business in Australia quote, track a job, prepare compliance paperwork and invoice. By signing up or using the app you agree to these terms.

2 Your account

• Give us true details and keep them up to date, including your ABN and licence number.
• One account is for one trade business. Keep your password to yourself.
• You are responsible for what happens under your account.

3 The trial and the plan

The first 14 days are free and we do not ask for a card. After that the plan is $49 a month, including GST. You can cancel any time and you will not be charged for the next month. If we raise the price, we email you at least 30 days before it starts. If you paid in the 30 days before that email, you keep your old price for 3 months after the new price starts. You can cancel any time before a rise starts. A price cut starts straight away.

4 Text and AI credit

Texts and Novato Assist use credit. Text packs and AI credit are optional extras. The price is shown before you buy. Email is included and has no limit set by us.

5 If your plan lapses

When the trial ends, or a payment lapses, you cannot sign in. We keep your account and your work, and you pick up where you left off when you subscribe again.

6 Your work and your customers

• Your quotes, prices, templates and customer details are yours. We do not use your prices to set anyone else's.
• You must have the right to give us your customers' details, and you are responsible for the messages you send them through Novato Trade.
• We send messages for you only when you ask us to, and they are factual and carry your name.

7 Quotes, invoices and paperwork

You decide every price, line, term and deadline. Novato Trade is a tool, not legal or tax advice. The state rules, deadlines and wording in the app come from our notes and may be out of date or wrong for your job. Check them with your regulator before you rely on them. Novato Trade does not lodge any notice or certificate for you. You must do that yourself.

8 AI suggestions

Novato Assist suggests job types and lines from your notes. It can be wrong. It never sets a price. You read and decide everything before it goes to a customer.

9 Card payments

Customers pay by card through your own Stripe account. The money goes to you. We do not hold it. Stripe's terms apply between you and Stripe.

10 Using Novato Trade properly

Do not use it to break the law, to send spam, to mislead a customer, to attack or overload the service, or to get into anyone else's account.

11 Changes and availability

We work to keep Novato Trade running, but we cannot promise it will never be down. We may change or remove a feature. We will tell you about a change that matters to you.

12 Our responsibility

Nothing in these terms takes away rights you have under the Australian Consumer Law that cannot be excluded. Apart from that, as far as the law allows, we are not responsible for lost jobs, lost profit, a missed deadline, or any loss that was not a direct result of our breach, and our total responsibility to you is limited to what you paid us in the 12 months before the problem.

13 Ending these terms

You can stop using Novato Trade at any time. We may suspend or close an account that breaks these terms, and we will tell you why. Clauses that should survive, such as clause 12, do.

14 Law and contact

These terms are governed by the law of New South Wales, and the courts of New South Wales decide any dispute. We will email you about changes to these terms. Questions: trade@novato.com.au.
